UK care workers may be exempt from stricter ILR rules.

The change being proposed would protect migrant care workers living in Britain from a slower route to indefinite leave to remain but it is thought that stricter criteria could be introduced for those arriving in future.

Prime Minister Andy Burnham is reportedly weighing an exemption that would exclude migrant care workers already living and working in the United Kingdom from some of the government’s proposed settlement restrictions.

The Guardian reported the proposal would distinguish between existing care workers and new recruits. It could mean new arrivals face the tougher “earned settlement” regime, but existing rules for settlement may still apply to people in the UK.

But no waiver has been issued yet. The Government must first consult on the Home Office’s settlement consultation before it can decide whether to give transitional protection.


Existing workers may be provided transitional protection

But reports released on 24 July suggest Burnham is considering exempting care workers already legally located in the UK from the stricter settlement criteria.

If adopted, this would enable present workers to continue to ILR in a shorter qualifying period rather than being placed on a 10 or 15 year route retrospectively.

It is uncertain how far any exemption will go. The government has so far declined to say:

  • Which care jobs might qualify
  • Would dependents have the same kind of protection
  • whether workers would have had to have been in the UK before this date
  • whether the previous five-year ILR route will remain in its entirety
  • How changes in employer, occupation or visa status would affect eligibility

An exception would not automatically give care workers ILR.

Applicants will still need to meet the qualifying period and the relevant residency, wage, sponsorship, English language and suitability conditions in force at the time of application.


Why care workers might be treated differently

Social care providers have warned that a much longer pathway to permanent residence could make it harder to retain qualified foreign staff.

The sector has depended largely on recruits from abroad in recent years. 616,266 Health and Care visas were awarded between 2022 and 2024, according to official Home Office figures. Total principal applications 249,594 Dependents 366,672 Of visas granted to major applicants, 154,342 were to people employed in caring personal service occupations. Official Home Office figures also suggest that about 117,000 care workers would be eligible to settle between 2026 and 2030 otherwise.

Trade unions and care providers fear the need to wait for permanent residency will discourage workers from staying in the industry. Longer periods of temporary immigration status may reduce the attractiveness of the UK for skilled care professionals.

The government finds itself in a tricky policy position – it wants to cut the number of settlements but not add to the pressure on a sector already struggling with recruitment and retention.


Will everyone on a Health and Care visa be excluded from this?

At this time there is no evidence that all Health and Care Worker visa holders would be exempt.

The visa allows for a wide range of roles such as doctors, nurses, allied health professionals, care workers and senior care workers. The supposed recommendation seems to be intended mostly at migrant workers in social care who are already in the UK.Visa & Immigration The government has already singled out doctors and nurses in qualifying NHS posts in the government’s settlement proposals, with the government stating they might keep a five-year track. The position of care workers is more uncertain as they fall below the proposed RQF Level 6 standard.


What is intended to amend the settlement?

If you qualify under the current Skilled Worker system, you will generally be able to apply for indefinite leave to remain, or ILR – sometimes referred to as settled status – after five years.

The government’s earned settlement consultation is proposing to increase the normal qualifying time to 10 years. We are also looking at a later 15 year start date for Skilled Worker visa holders doing employment below RQF Level 6 (degree level equivalent).

The 15-year pathway proposed will be particularly harmful for care workers and senior care workers, given their jobs are generally rated below RQF Level 6.

Economic and social contribution may allow candidates to shorten the time to qualify. But the final eligibility requirements and potential reductions and transitional procedures are yet to be established.

No modification in immigration rule as yet.

Burnham is not anticipated to comment publicly on the possible exemption in his next speech on social care. The Home Office is now considering the settlement consultation and a decision might be made later in 2026.Visa & Immigration Care personnel should not assume that an exemption will be granted until the government has issued a public policy announcement and the necessary changes to the Immigration Rules.

Holders of an existing visa need to fulfil the current requirements of their immigration and sponsorship. They should also seek extensions or settlement on terms existing at the time of application.

The most important thing at this point is that the longer settlement periods are still just concepts. Existing care workers could get transitional protection but the Home Office will not announce the qualifying occupations, dates and criteria until later.
