On 13th March 2024. The UK Home Office commissioned the Migration Advisory Committee to conduct a rapid review of the Graduate Route Visa, a post-study work option for international students. The UK Home Secretary, James Cleverly, officially triggered the government’s review of the Post-study work rights graduate route this week. In an 11th March letter to Migration Advisory Committee, Mac Chair Brian Bell. Secretary Cleverly outlined the terms of reference for the review and requested that the Mac completed its work by the 14th May 2024, a deadline that provides for a window of roughly ten weeks for the Mac to complete its work. The review had previously been announced by the UK government and has been anticipated for some months.

The graduate route allows students to remain in the UK for two years post-graduation, or three years for PhD graduates without a sponsor. Eligibility requires successful completion of a degree at a higher education provider and prior permission under the student route. A recent analysis by universities UK concluded that the expanded Post-study work rights available under the graduate route helped to add more than 600,000 additional international enrolments and over €60 billion to the UK economy between 2019 2020 and 2023-24. The government’s request for review stems from concerns about potential immigration abuse and the desire to maintain the quality reputation of UK universities, with 175,872 visas granted since its inception. The roots impact on the education sector and the UK economy is under scrutiny.
The Home Secretary’s letter sets out the terms of reference for the review as well, namely that the process should consider one any evidence of abuse of the route, including the route not being fit for purpose, who is using the route and from what universities they graduated. Two demographics and trends for students accessing a study visa and subsequently accessing the UK labour market using the graduate route. Three what individuals do during and after their time on the graduate route, and whether students who progress to the graduate route are contributing to the economy. For analysis of whether the graduate route is undermining the integrity and quality of the UK higher education system, including understanding how the graduate route is or is not effectively controlling for the quality of international students.
The Home Office has been open about the drive to reduce net migration to the UK. This has included drastic changes to the skilled worker route, such as increasing the salary requirements and banning care workers from bringing dependent family members to the UK. The Home Office has requested Max report by 14th May 2020 for a significantly shorter time than normal commissions. The Mac has already stated that this will substantially limit the quality and quantity of evidence they can provide, which questions whether the Home Office is genuinely seeking to better understand the route, or simply looking for a reason to withdraw it. Universities UK has also weighed in on the question of the short window for the review. Universities UK international director Jamie Arrowsmith said we are deeply concerned by the accelerated timetable which appears to be driven by political, not policy, concerns.
The government should give the Mac the time it needs to properly review the graduate visa, allowing the committee to consider the full range of evidence and engage in meaningful consultation rather than asking them to rush their response. Many people, however, have reacted negatively to this rushed review of the graduate visa route and given their own opinions on it. But until May 14th, we cannot say anything will change.
