Important information about Certificates of Sponsorship (COS UK)

Urgent Notice: (COS) Certificates of Sponsorship under UK Immigration Rules: Act Before 7 PM on April 2nd

Greetings, sponsors and sponsored employees! The UK’s Immigration Rules are about to undergo significant changes that will go into effect on April 4, 2024. All parties concerned must pay immediate attention to and take action in response to these changes, as they will have a direct impact on the issuance of Certificates of Sponsorship (CoS).

To make sure you understand how these changes may affect you and your sponsored workers and what steps you may need to take, please carefully read this annexe.

What is changing

The Immigration Rules will undergo significant revisions that take effect on April 4, 2024. Among them are:

  • Changes to some occupation code numbers and job descriptions will result from the Standard Occupational Classification (SOC) 2020 system replacing the SOC 2010 system currently in use in Appendix Skilled Occupations.
  • raising the pay thresholds for seasonal workers, skilled workers, scale-up workers, and workers with global business mobility

Any application for admission clearance or authorization backed by a Certificate of Sponsorship issued on or after April 4, 2024, will be impacted by these modifications.

Sponsorship management system unavailable

The sponsor licence application form and the sponsorship management system (SMS) will not be available from 19:00 hours (7 pm) on April 2, 2024, to 09:00 hours (9 am) on April 4, 2024, in order to implement these changes.

Throughout this time, you won’t be able to:

  • submit an application to renew your licence, add routes to your licence, or become a sponsor.
  • apply for any DCoS (Certificate of Sponsorship Defined by Skilled Worker).
  • Request to have your allotment of Undefined Certificates of Sponsorship (UCoS) increased or renewed.
  • Give any workers you want to sponsor Certificates of Sponsorship (CoS)

Therefore, in order to apply for or assign any CoS before these changes take effect, you will need to act. Only applications for skilled workers are impacted by the DCoS changes.

DCoS applications made before 7 pm on 2 April 2024

Before these changes go into effect, if you need any Skilled Worker DCoS, you should apply as soon as possible.

Before 7 p.m. on April 2, 2024, we will process as many DCoS applications as we can. Any applications that are still pending at that time, however, will be rejected. In the event that your application is rejected, you will have to reapply on April 4, 2024, after 9:00 a.m., using the updated salary thresholds and applicable SOC 2020 occupation codes.

Please make sure your DCoS application has all the necessary information included in it so we can process it right away and avoid having to cancel it. If additional information is required, it is unlikely that we will be able to process your application in a timely manner.

DCoS applications granted before 7 pm on 2 April 2024

As of April 4, 2024, no DCoS granted with a SOC 2010 occupation code may be assigned. This is due to the fact that their occupation code will be incorrect and cannot be changed.

You have until 7 p.m. on April 2, 2024, to assign any DCoS that you have been granted with a SOC 2010 code to a worker. If you don’t, the DCoS will be cancelled, and you’ll have to apply again after 9 a.m. on April 4, 2024, using the updated salary thresholds and applicable SOC 2020 occupation codes.

UCoS allocations

Between 7 p.m. on April 2, 2024, and 9 a.m. on April 4, 2024, you will not be able to apply for a renewal of your allocation or a request for an increase in your UCoS allocation.

We will consider your request as normal if it was submitted before 7 p.m. on April 2, 2024. If it is not decided upon (or if you do not assign any CoS assigned to you) before that time, you must make sure that any CoS you assign after that date complies with the new Immigration Rules.

These changes have no bearing on the allocations of UCoS that currently exist. However, you must assign a CoS to the worker by 7 p.m. on April 2, 2024, if you want to sponsor a worker under a SOC 2010 occupation under the current Immigration Rules.

You must update any UCoS with the appropriate SOC 2020 occupation code and make sure they meet the updated salary thresholds before you can assign them to a worker if they have any with the status of “work in progress” or “ready to go” and you haven’t assigned them by 7 p.m. on April 2, 2024.

CoS assigned before 7 pm on 2 April 2024

Workers who have been assigned DCoS or UCoS by 7 p.m. on April 2, 2024, will not have their assignments cancelled. They will continue to be valid for the customary three months.

Even if the worker applies on or after April 4, 2024, applications for entry clearance or permission made using these CoS will be evaluated in accordance with the salary thresholds and SOC 2010 occupation codes under the Immigration Rules in effect prior to that date.

Given these impending changes, sponsors and sponsored employees must move quickly and carefully.
