STATEMENT OF CHANGES IN IMMIGRATION RULES: The many changes which was announced on 10th of September 2024 by the UK Home Office. However, for my readers, there are only three changes which are relevant which I’m going to cover, which is regarding the student visa, skill visa and carer’s dependant visa.

The official link in the bottom of this post. So there are two documents which is published. One is 15 page document and second is 78 page document.

1. UK Student Financial requirements

The first update is regarding the student financial requirement. What does it mean? It's about the proof of funds. As you know for student visa people who come here for student visa, they have to show some funds in their account so that they can support themselves while they're in the UK. And this does not include your tuition fee. It doesn't include your flight or accommodation. This is completely about the proof of funds that you have to show. There's increase in it.

As you know, in the UK the inflation due to high cost of living. The UK government did not touch the financial requirement for students from 2020. They thought this is a good time to update it to reflect the current changes or the current inflation rate, and hence they have updated a little bit. For people who are planning to study in London, the new maintenance cost for you, which you have to show is £1,483, which equates to around £13347. So make sure you have that kind of fund in your account. If you're planning to apply for a student visa from second of Jan 2025, none of the students will be impacted. If you came here for the September 11th, it's only for the future. Students from Jan 2025 now, for students who are coming outside of London, your new maintenance cost per month is £1,136, which equates to 10224 for nine months and approx in Indian rupees.This is going to cost you around ₹1126000. If you're planning to come in Jan, make sure in December check the exchange rate. And it's always advisable to have a little bit more money rather than having a less money. So make sure you just check the exchange rate before you arrange that fund. Now this little known to it.

Appendix Student

5.26 There is a maintenance requirement for student applicants to demonstrate they have
funds to support themselves for each month of their course (up to nine months). This
level of funds for international students to demonstrate was originally matched with
the maintenance loans available for home students, but the maintenance requirement
for international students has not been updated since 2020.

5.27 This change increases the maintenance requirement for international students to match
the maintenance loans available for home students for the 2024-25 academic year. We
will ensure it aligns with home students’ maintenance loans in future.

5.28 We have also updated the maximum amount for the accommodation offset in line
with the changes to the maintenance requirement. The accommodation offset allows
students to demonstrate less maintenance funds if they have paid a deposit for their
accommodation in the UK.

• -The financial requirement will be updated regularly. Maybe in October, this may be updated if the cost of living has gone up. So make sure if you are arranging this money you keep looking through the UK government website if that amount is the same or is it changing?
• Now the figures which I talked about now this can be offset for students who are already making their payment for the UK accommodation. So say from India you’re sitting and booking your accommodation for six months, then you don’t have to show the whole funds. You may reduce that fund if you are showing that booking for say nine months, again, the amount will be very less because you’re already saying that you’re already paying £800 or £900 per month, so that amount will be reduced. You don’t have to spend, you don’t have to show that money.
• If you have been in the UK on another route for at least 12 months, you do not need to show any maintenance parts. So those are the updates.

This is just a snippet from the UK government website. Again, I’ll provide the link so that you can read it. This is based on my understanding of the updates which are provided.

2. UK Skilled visa: job code and Going rate update

Now let’s move to update number two which is about the skilled skill visa. There’s one major update.

5.40 The updates made in HC 590 to occupation codes and going salary rates contained a
number of data/drafting errors, which are being corrected.

You may think this is just one liner, but no, the impact is huge. The line says the updates made in 8592 occupation codes and going salary rates contain a number of data and drafting errors which are being corrected. So what does this mean? So first of all, we already know in the UK for anyone to be sponsored on skill visa, there’s a job code and there’s a going rate to it.It looks like the job code was also wrong and the going rate was also wrong for few of the jobs, which is now corrected. What did the UK Home Office did on 28th of August 2024? They send a message to all the licensed sponsors in the UK. They have a system which is called SMS system, which is used for sponsor licence management system. And this was the message which was sent by saying, hey, there were some errors on the job code and the going rate for the list of the job codes, and hence this is fixed now. So make sure you review this and whenever you issue a new visa, it needs to be with the correct us and with the correct going rate. Now I was trying to find out if there are more details around it.You can discuss with your sponsor if you are already on a skill visa. If your visa was rejected or any ground because of the error, you can still go back and work with the solicitor to put forward your case so that your visa doesn’t get rejected again.

Which Codes were affected by the error?

If you compare the going rates in the Appendix Skilled Worker Occupation Codes link in the Rules and the above guidance, it appears the following Occupation Codes are impacted:

So these are the job codes. Either the job codes are fixed or the going rate is fixed, which is very important.

3. UK Carer – Dependent visa update

Last update, which is regarding the dependents of care workers. Now, till now, I see there are questions about the dependence of care workers, whether they allowed or not allowed some of the questions, which I have already picked from my last POST, which I published last week. People are saying, hey, I’m on a student visa now, I’m moving to PSW but I have got a job as a carer. Can I bring a dependant? Given that I’m already in the UK, the answer is no. For people who are already applied for a carer visa before March this year, then you can bring your dependents. Say you were not married in Jan, but you got married only say in July now because your visa was granted before March this year. You can bring your dependent not because you are already in the UK, say on a student visa or any other visa dependent visa.

But you do not have a carer or senior carer visa. You cannot bring your dependent. This is the biggest confusion. Now I know you are reading somewhere different information about children. There was a big confusion about children whether they are allowed or not allowed.

5.41 In order to avoid leaving children of care workers already in the UK in a position
where they are unable to make extension applications and to comply with
safeguarding objectives, two further allowances are being added to the immigration
rules for dependants of care workers under the Skilled Worker route. This does not
alter the overall position that these workers cannot bring dependants to the UK, nor
can their dependent children switch from other routes if there is another parent who
can reasonably care for them overseas.

Two rules they have said for children. Now, for people who are already in the UK, what are they saying? These rules will help ensure the children can stay longer if needed and meet the safety standards.If you’re already in the UK and you are a single parent. Yeah, whether you are a mom or a dad, you can keep your children. And the rule two says if the children have another parent who can take care of them in another country, they cannot switch to stay in the UK. You are a single mom and your partner has a father of the child is in India, and if your father of the child can take care of the kids, they cannot stay with you. They need to go back. So this is only for single parent, either mom, single mom or single dad who are on a carer visa. And if you have a children, they can stay with you only if nobody else can take care of them, especially the partner in a different country. This is what I have understood.

There is no other changes about care. Workers can bring their dependents. No, there’s no change. You cannot bring your family, basically your partner or your children or people who are getting a new visa after March 2024. So those are the three major updates.

Which is about the top ten worst courses to study in the UK for international students who want to settle in the UK. Remember, if you have less than two years of experience, do not plan to come to the UK due to recent changes in the salary threshold, which means freshers will never get high salary and hence you will not be eligible for UK work visa, which is called Skill Visa.

10. Hospitality, Leisure and Tourism

We know personally many students who are currently in the UK and they are struggling to find visa sponsorship jobs under this category unless you are a chefs. Hence, my suggestion is to stay away from the courses like MSC Tourism and Events Management and MSC International Events and Conference Management MSC Global Management. This is not a niche field, and they have enough local people to do such kind of jobs.

9. Dramatic and Creative arts

Creative and dramatic arts is a highly competitive field with limited job opportunities and low pay. We will not suggest that you take Master of Contemporary Art practices, Bachelor of Arts, Master of Design, Master of Professional Writing, Bachelor of Arts in International Relations, etc.

8. Supply Chain

If you have three or more years of experience from your country in hard core supply chain industry, then only offer this course. Otherwise, we will suggest you stay away from MSC Supply Chain Management, MSC Supply Chain Logistics Management, MSC Strategic Operations, and Supply Chain Management, etc. students are literally crying here as they don’t have any prior experience and they are not able to secure a job in their field. Most of the students are opting for carriage jobs because they don’t see any other option for themselves now.

7. History related

If you want to study history and teach in schools or universities, We’ve seen only Stem courses teachers get sponsorships. In fact, from first Feb 2023, if you are a teacher from this nine countries, you can apply for cuts, which means your chances of getting visa sponsorship from your country will be much easier now. And you don’t even need to come via study route, so I don’t recommend you to take MA history of Art, MA World History and Cultures, Masters of Arts, etc.

6. Sports

Our suggestion is to not take MSC Sports Management, International Sports Management and my reasoning is same as all other courses which we discuss now. Less jobs and hardly any visa sponsorship jobs for you.

5. Agriculture science courses

Mainly horticulture and viticulture students who are currently studying BSc honours horticulture or FdSc. Horticulture with Garden Design are struggling to find jobs in the UK market. We are not even talking about visa sponsorship, but even landing a proper job in their field. And most of them are working in a warehouse or retail store, and hence my suggestion is to stay away from such courses.

4. Fashion and Interior design

Fashion design is another highly competitive field in the UK with limited job opportunities. Additionally, the pay is not very high and there’s a lot of pressure to be creative and innovative. So stay away from Ma Luxury Brand Management, MSC International Fashion Retailing, Master of Science in Corporate Brand Management. It’s better to do such courses from your country and try to work with big brands and then move abroad via those brands, rather than targeting to study abroad through this courses.

3. Sales courses

This is another course which will not give you visa sponsorship unless until you already have some work experience or working with the UK market. Our suggestion is to stay away from courses like MSC business with marketing MSC. Digital Marketing Communications MSC. Management with Digital Marketing. Remember guys, there are few students who are able to get visa sponsorship with the right planning, strategy and networking skills, but majority of them are still not succeeding. We have very few examples of people who succeeded with sponsorship, and the majority of them are still struggling, so just be careful now.

2. MBA

MBA stands for Master of Business Administration that provides an overview of key business practices. An MBA is not an entry level business qualification. It is usually taken by professionals who have gained at least 3 to 4 years of business and management experience since graduating from undergraduate study. However, even freshers are taking MBA because it’s one of the easiest courses to get into. And We know your agents are pushing you to take this course as the success rate of admission is really high. So if you’re a fresher or someone with less than three years of experience,  would not recommend you to do MBA as this will not land you a job in the UK in your field, and you may struggle to get a visa sponsorship in the UK unless until you are exceptional students and you possess some specialised skills and try to take a course with some specialization rather than a generic course like MBA.

1.MIM

MIM is targeted for freshers. And if you are reading my articles for some time, you should already know that UK market is not favourable for freshers and UK is not degree based market but experience based market. So We personally think this is not the right course for international students. Please gain some work experience in your country even before planning for higher studies in the UK.

Before We conclude this post, we want to say this analysis is based on my research and our understanding of the UK market. However, you should do your research for your area and look at the new and. The latest trends so that you don’t regret later when you arrive here and make your decision accordingly. Challenge your agents. Ask them the right questions. All the courses and jobs which we discussed today are not listed in UK Shortage Occupation list, which means there will be only a few companies who will be ready to provide you sponsorship for those jobs. So if you are wondering why it is not in the UK shortage occupation list, it’s because British people are quite good in management and strategic skills, so they have plenty of people here who are available locally who can do that kind of jobs. And hence getting visa sponsorship job is not easy, but it’s not impossible either. UK Immigration And News Updates: Today, we explain two significant news updates that have occurred in the recent few days. Will the NHS begin hiring immediately? What are the NHS’s latest plans? The second update has to do with international students.

1. NHS UPDATES

No extra NHS funding without reform, says PM

As he committed to creating a new ten-year strategy for the health sector, Sir Keir Starmer states that further cash for the NHS will not be provided without reform.
The promise was made following the dire warning that the English NHS was in “critical condition” in a devastating study.
The new plan, which the prime minister said would be “the biggest reimagining of the NHS” since its formation, is scheduled for publication in the spring.

Still, the Conservatives insisted that after abandoning plans to build new hospitals and improve social care, the government needed to move from “rhetoric to action”.

Sir Keir outlined three main areas for reform: shifting the NHS to a digital platform, shifting more care from inpatient facilities to community settings, and prioritising health and prevention over illness.
Lord Darzi, an NHS surgeon and independent peer, reviewed the study for nine weeks before it was finalised.
Shortly after the election, Labour asked him to list the shortcomings in the health service, but he was not tasked with proposing fixes.

He claims that the service is in “serious trouble” due to decreased productivity, “ballooning” wait times, and “awful” emergency services that put patients at risk. His findings paint a stark picture of this situation.

In response to the study, Sir Keir stated during a speech in London that more money alone would not fix the issues.
“We cannot avoid lasting change. Reform is the answer to this; additional money won’t just solve it.”
Sir Keir discussed transforming it into a “neighbourhood health service” and declared that it would be “so different” from all previous initiatives.

Together with the return of the family physician and the provision of digital consultations for individuals who desire them, this would entail “more tests, scans, and healthcare offered on high streets and towns centres.”

“Hear me when I say this – no more money without reform.”

It is unlikely that NHS recruitments that were halted for funding reasons will pick back up under these conditions. With the update that will be released in the next few days, it is anticipated that the NHS plan will become clearer.

2. INTERNATIONAL STUDENT VISA UPDATES

UK raises maintenance requirements for international students

For the first time since 2020, the UK Home Office has raised the amount of money that overseas students must save.

International students entering the UK are required by law to show that they have enough money saved “for each month of their course (up to nine months),” according to the Home Office.

The amount of money is dependent on rises in the maintenance loans that are offered to domestic students; however, this hasn’t changed since 2020.

The new regulations stipulate that students intending to study outside of London must have £1,136 per month, while those arriving in London must provide proof of having £1,483 per month.

International students studying in London are currently required to provide proof of monthly savings of £1,023 outside of London and £1,334.

Syed Nooh, Head of Global Insights and Market Development at UEA, told ThePIE, “On the one hand, it is understandable that the UKVI has decided to increase the maintenance funds requirement for international students to align with rising inflation and the general increase in the cost of living across the UK.”

But Nooh said, “the UK risks portraying itself as a less accessible alternative, especially for students from lower-income countries,” given that other, more reasonably priced study abroad locations are aggressively luring international students.

Students entering the UK on or after January 2, 2025, must meet the revised standards, which were released on September 10, 2024. The government has said that it will continue to update the financial need on a regular basis to account for rises in domestic maintenance loans and inflation.

When applying for a visa, students who plan to study in London for nine months or more would need to provide proof of their total savings of £13,348.

The University of Exeter’s head of international student recruiting, Nick Skeavington, believes that while the move alone is unlikely to have an effect, it is one of several recent policy changes that have made the recruitment environment more difficult.

“It is imperative to contemplate [the amplified maintenance prerequisites] within the broader framework concerning modifications to the dependents’ visa policy, monetary and cost issues in pivotal markets, particularly in West Africa and South Asia, along with the noteworthy escalation in the NHS surcharge this year,” Skeavington stated to The PIE.

According to the government, if students have paid a deposit for their accommodation in the UK, they can still “offset” their proof of funds and show fewer maintenance funds.

Additionally, you are exempt from demonstrating maintenance funds if, as of the date of your application, you have been in the UK on a different route for at least a year.

The significance of “ensuring that students have sufficient financial support… to avoid hardship during their studies” and the “necessary alignment with the increased maintenance loans for domestic students” were acknowledged by the stakeholders, according to Nooh.

“Students from developing countries may find it more challenging to meet these increased financial requirements,” he said, “which could potentially lead to a less diverse campus environment.”

On February 6, 2024, the NHS surcharge for students wishing to study in the UK increased by 66% to £776 annually.

In addition to paying tuition that can be up to three times greater than that of local students, overseas students must additionally pay fees for their visas and biometrics, as well as taxes while they are employed in the UK.

2. ACADEMIC FAILURE

Another reason why a lot of students get their visas revoked is academic failure. If you consistently fail your courses, your university might revoke your visa leaving you without a legal status in the UK. 3. CRIMINAL ACTIVITY

Next, engaging in criminal activity and even something very minor might actually lead to your visa being revoked. The UK has a very strict stance on criminal behaviour, and even the smallest instances of criminal activity could have you in big trouble. So whether it’s rioting out on the streets and irrespective of the reason, looting causing bodily harm to anyone. Any of these things can immediately get you deported.

Be aware of the laws in the UK and think twice before getting involved in anything questionable. Remember, what might be seen as a minor offence in your home country could be taken as a major offence in the UK.

4. WORKING ILLEGALLY

Now, another reason for UK students getting deported is not following working regulations. Many international students work part time to support themselves, but they actually work beyond the permitted hours. And many times students aren’t even aware that they aren’t really allowed to do certain jobs. Like, for instance, you aren’t allowed to earn through social media and you aren’t allowed to be a delivery food delivery driver in the UK because, again, like being employed with social media, it’s called being self-employed, which you aren’t really allowed to do in the UK. So it’s important for you to know what the work limit is attached to your visa. Typically, you’re allowed to work up to 20 hours a week during term time and up to 40 hours a week when it’s holiday time.

Stick to these limits and work only in the approved hours. And if you aren’t sure what jobs are allowed, first check the visa letter to the detailed at all the information and what you can and can’t do. And if you’re still unclear, ask your university ,

5. MISREPRESENTATION OR FRAUD

Providing false information on your visa application or any official application can lead to your visa getting revoked, and this could be anything from falsifying your academic records to lying about your financial situation. Always provide accurate and truthful information in any paperwork provided to you. Double check all the documents before you submit them and seek professional help if you are unsure on anything.

6. FAILURE TO PAY COURSE FEES IN TIMELY MANNER

Failure to pay your course fees in time again can lead to your visa being revoked. Earlier this year, many Nigerian students were left stranded. The Nigerian naira plummeted in the midst of an economic crisis, leaving many students unable to pay their fees immediately. As a result, a very popular UK university terminated their student visas and in many cases shortly before they were just about to graduate.

If you do plan on studying in the UK, ensure that you are in a financial position to pay all of your course fees in regular instalments regularly, because even a small delay could lead the university to withdraw your application now. Labour will not do away with Tory visa restrictions for overseas students, according to the education secretary. Restrictions on international student visas were put in place to stop the majority of foreign students from entering the UK with dependents.

The government does not intend to remove the visa limitations that the former Conservative administration placed on international students, as revealed by Labour’s education secretary.

Most international students are unable to bring family members to the UK due to the limitations, which were implemented in January.

In an interview with Sky News, Bridget Phillipson was questioned if the immigration regulations ought to be changed.

“We don’t intend to change that,” was her response.

The minister of cabinet commended the “extraordinary impact” that foreign students had on the nation’s economy and local communities.

“In terms of the communities in which they will settle, Sunderland, where I am a member of parliament, has a large number of international students who come here to study and contribute. Many of them are postgraduate students,” the speaker stated.

There has been a nearly 80% decrease in the number of dependents travelling with foreign students to the UK, according to recent reports from the Home Office.

According to the data, there were over 26,000 fewer applications for student visas filed between January and March 2024 than there were during the same period in 2023.
